Ex-girlfriend accused of murder spotted near crime scene day body was found, court hears
A witness says he saw Tamsin Glass in her car near an Angus nature reserve where Steven Donaldson's body was found last June
A murder accused seemed 'calm' as he spoke of how a baseball bat was 'smashed' over a man's head with 'one swing', a court has heard.
Jamie Stewart,30, told a jury on Monday how Callum Davidson,24, made the remarks during a conversation outside a supermarket in Kirriemuir, Angus, on June 7 2018.
The High Court in Edinburgh had earlier heard heard how the body of Steven Donaldson,27, had been discovered in the town earlier in the day.
Mr Stewart told prosecution lawyer Ashley Edwards QC how he was with his then girlfriend Claire Milne when he saw Mr Davidson with his co accused Steven Dickie,24,.
He said: "Callum stepped out to speak to my girlfriend. He asked us about what had happened the night before.
"He said he had been there when some of it happened.
"He said there had been a carry on up at the park and a baseball bat had been smashed over the person's head. He said that a baseball bat had been snapped over his head with one swing and that he had punched him and he got rid of the weapons.
"He said that he had left Tasmin's dad up there to deal with it. I looked at Callum and shook my head and told my girlfriend 'let's go' and walked into the shop."
Mr Stewart, of Kirriemuir, was giving evidence on the sixth day of proceedings against Mr Davidson, Mr Dickie and Tasmin Glass,20,.
The trio, who all come from the Kirriemuir area, deny murdering Ms Glass's former boyfriend Mr Donaldson, of Arbroath, in their home town between June 6 and June 7 2018.
On Monday, Mr Stewart told the court that he had became aware that a body had been found at a nature reserve in the town after listening to the radio on June 7.
He said he drove past the location where the human remains were found and saw the police there.
Mr Stewart, who is currently unemployed, also said he saw Tasmin Glass's car parked close to a police car.
When Ms Edwards asked him what he then saw, Mr Stewart said: "She was slumped over her steering wheel."
Later in the evening, Mr Stewart said that he and Miss Milne were going shopping and were stopped by Mr Davidson outside the Co-Op in Kirriemuir.
When Ms Edwards asked Mr Stewart for more details about what was said in the conversation, the witness said: "Callum said he had taken and got rid of the weapons. He said he was taking it out to his granny's farm.
"He wasn't directly speaking to me. It was actually my girlfriend he was speaking to. He seemed pretty calm. I said 'that's going to get you years for doing that'.
Mr Stewart said he later visited a cafe that Miss Glass was working at.
When Ms Edwards asked him about the visit, Mr Stewart said: "Tasmin was working. She took our order. She seemed fine and calm."
Prosecutors claim that between June 6 2018 and June 7 2018, Mr Dickie, Mr Davidson and Ms Glass arranged to meet Mr Donaldson at the Peter Pan play park in Kirriemuir, Angus, and assaulted him there by striking him with "unknown weapons".
It's alleged that Mr Donaldson was then "incapacitated" - the trio are then alleged to have taken Mr Donaldson to the nearby Loch of Kinnordy nature reserve car park.
Once at the park, the Crown claims that Mr Donaldson was struck on the head and body with a knife, a baseball bat, or similar instruments.
The trio are then alleged to have struck Mr Donaldson on the head and neck with an "unknown heavy bladed instrument".
They are then alleged to have set fire to Mr Donaldson and to his car.
Mr Dickie and Mr Davidson also face a number of other charges including assaults and behaving in the a threatening or abusive manner.
The trio have pleaded not guilty to all charges.
