A man who raped a sleeping woman at a Dundee flat – then apologised for what he had done - was today jailed for 27 months.

Greg Fraser, 22, raped his victim in October 2017 with the woman only realising he had sex with her after she woke up

At the High Court in Glasgow Fraser pled guilty to raping the woman.

Judge Lady Stacey told the first offender: “The court has to take this very seriously. Under the law of Scotland to do what you did is rape – a most serious offence. However I accept at the time you were naïve and immature.”

She said that but for his early guilty plea she would have jailed him for three years.

Prosecutor Allan Nicol told how Fraser, from Dundee, had been with the girl at the flat.

He pestered her for sex that night, but she refused.

The court heard the woman ended up falling asleep watching television.

When she later awakened, Fraser was sitting near her.

Mr Nicol: “He was smoking a cigarette. He said he had tried to wake her up.”

The woman was then shocked to discover Fraser must have had sex with her while she was sleeping.

Mr Nicol told the court: “He said he was sorry.”

The victim later told her mum what had gone on.

She was initially reluctant to go to police, but went onto report her attacker last year.

Defence advocate Lorraine Glancy said: “After he spoke to the victim and to a friend he realise that not only was his behaviour unacceptable, it was also a criminal act.

"He was anxious that she should not have to give evidence and pled guilty at the earliest opportunity.”

Fraser was placed on the sex offenders register.
