The case involves an alleged agreement made between Axl Rose and Activision, the makers of the the computer game Guitar Hero III: Legends Of Rock which said that the game would not feature Slash or Velvet Revolver. The game not only featured an image of Slash on the cover, but he also featured in subsequent adverts promoting the game along with Velvet Revolver songs available as downloadable tracks.

Axl is keen to make sure that Guns N Roses is not associated with its former guitarist.

"Simply put, the association between Slash and Guns N’ Roses ended almost 15 years ago. Rose resists any attempts to revive or strengthen this past association," the complaint says.

After a brief hearing on Thursday, Los Angeles Superior Court Judge Charles Palmer agreed the lawsuit can proceed. The trial is scheduled for 23 January, 2012.
