Sheriff wants comparative value to determine scale of crime

A Kiltarlity woman will be sentenced next month after she admitted 15 charges of possessing fake designer clothes, jewellery and electronics for sale. Sentence had previously been deferred for a background report. Last month, Donna Stewart, who originally faced a total of 43 charges, pleaded guilty to the reduced number of charges of possessing goods with fake labels involving some of the world's top names. She had sold the items from at addresses in Beauly and Kiltarlity in 2013 and 2014. However fiscal depute Stewart Maciver was unable to answer Sheriff David Sutherland's query about how much the real goods would have sold for, saying: "It is almost impossible to sentence without knowing the comparative value if they were legitimate goods" The Sheriff then deferred sentence for a second time with 38-year-old Stewart set to re-appear on April 12th. Stewart admitted possessing various items of clothing and jewellery likely to be mistaken for registered trademarks. Some of the false trademarks included Stone Island, Hollister&Co, Barbour and Burberry. She also admitted having a watch with the Rolex brand name, a ‘Tiffany' necklace and bracelet, ‘Ugg' boots and a scarf. Other fake goods named in the charges included ‘Jimmy Choo' perfume, ‘Louis Vuitton' purses and bracelets, a set of ‘Beats' electronic headphones and ‘Chanel' make-up and ear-rings. The court was told then that the maximum sentence that could be imposed for such an offence was six months imprisonment.
