All you need to know about the new penalties for using your phone when driving
The new penalties come into effect on the 1st March
From today (March 1st) penalties are getting tougher for drivers who use their mobile phone whilst driving.
The previous punishment was ÂŁ100 and a three-point penalty, however this has now doubled to a ÂŁ200 fine and six-points.
If you're caught twice you will automatically appear in court and could receive a fine of ÂŁ1,000 and driving ban of at least six months.
When can you use your mobile phone behind the wheel?
It is illegal to use mobiles and any other internet enabled devices such as tablets.
If I'm stopped can I use my mobile?
The law still applies if you are at traffic lights or queuing in traffic and you are also not allowed to use your phone even if you're parked up if the engine is still running. If the engine is off and you are parked up safely you can use your mobile.
Can I press buttons on my phone?
You can use your phone as a sat nav if it is secured in a holder and out of the 45-degree angle of the driver’s view, but you are not allowed to press any buttons.
What about a hands-free kit?
If police think you are not in control of your car while using hands-free then you can receive a ÂŁ100 fine.
Are there any exceptions?
Yes, there is one exception and that is to call 999 if you are unable to stop (for safety reasons).
Can I eat and drink while I'm driving?
You are allowed to, however motorists can be prosecuted for careless driving if they are distracted by their food.
What about smoking?
You can smoke as long as it is not a distraction, however you can’t smoke in a car if anyone is aged under 18.
Can I change the radio station?
As long as it is not a distraction.
