42-year-old Ali Mazin Mahmod from Felling was assaulted on Sunderland Road on May 2nd and later died in hospital.
22-year-old Gary Pitt from Falstone, Leam Lane, was due to appear in court on May 11th.
A 26-year-old man was been released with no further action.
