Drink driver jailed after causing fatal crash in Evesham
37-year-old Mariusz Kosinski has also been banned from driving for 13 years

A 37-year-old man from Evesham, has been sentenced to ten-and-a-half years in prison after killing his passenger in a crash while driving under the influence of alcohol.
At Worcester Crown Court on today (February 13th) Mariusz Kosinski, 37, of St. Matthews Close, was sentenced for causing death by dangerous driving
Kosinski was also banned from driving for 13 years.
The crash happened at around 5:30pm on Friday 27 July 2024 when Kosinski crashed his car on the A46 Evesham bypass, while more than twice over the legal alcohol limit.
It resulted in the death of his front seat passenger 40-year-old Pawel Czubacki from Evesham, who suffered fatal injuries.
Witnesses reported seeing Kosinski's BMW being driven aggressively and erratically before the collision, making dangerous overtakes, including moving on to the opposite side of the carriageway to get past other vehicles.
The crash happened Kosinski was approaching Bassey Island, as he attempted to overtake another car and with the central gap now narrowing and an oncoming vehicle on the opposite side of the road, he lost control while trying to manoeuvre around it.
His BMW went into a spin, sliding sideways towards the island, then flipped over and landed on its roof coming to rest in amongst the grass verge and hedgerow.
Despite emergency services' efforts of emergency services Mr Czubacki was declared dead at the scene.
Kosinski was arrested at the scene, where officers described smelling alcohol on his breath.
He failed a roadside breath test at the scene, recording a measurement of 80 micrograms of alcohol per 100 millilitres of breath – more than twice the legal limit of 35 micrograms.
Kosinski was also found to be over the limit of 80 milligrams per 100 millilitres of alcohol in blood - registering 84 milligrams - when his blood was taken some time later.
A mirror dashcam unit retrieved from the scene gave police evidence of his dangerous driving prior to the crash and evidence of the collision from the point of view of Kosinski's vehicle.
Sentencing today his Honour Judge Cartwright said Kosinski deliberately ignore the rules of the road, and in doing so showed a disregard for the safety of other road users while “showing off” the high-speed performance of his own car.
Detective Constable Danny Somner, of the Serious Collision Investigation Unit South, said: “We are pleased to get this conviction and sentencing for Kosinski today whose appalling driving resulted in the tragic death of his passenger and put many other motorists at risk of serious harm that day. His actions were exacerbated by the fact he was also over the legal alcohol limit.
“No sentencing will every compensate for the sad loss of life here, but we hope it will provide the chance for Pawel’s family and friends to begin to move on with their lives now.
“It would be easy to think that what happened was just a one-off lapse of judgment or moment of madness, however, the footage recovered from Kosinski’s dashcam showed his usual driving was risky and dangerous, so it is right he is behind bars and has been handed a lengthy ban from the roads.”
