A Witham has been cleared of a murdering his dad after new evidence determined the death of the 79-year-old was due to natural causes.
The case was discontinued at Chelmsford Crown Court on Monday 8th December after the Crown Prosecution Service (CPS) offered no evidence.
Police had been called on Wednesday 8th January 2025 following reports that Thomas Collier, of Philip Road, had sustained a head injury.
He was taken to hospital for treatment but later died.
Jimmy Collier was subsequently charged with murder.
Expert pathological evidence, received ahead of the trial, concluded that Thomas Collier had died of natural causes rather than injuries related to the alleged assault.
In a statement, a spokesperson from the CPS said, “Our thoughts remain with the loved ones of Thomas Collier following his death.
“Ahead of trial, we received expert pathological evidence which concluded Mr Collier died of natural causes – with no clear link to the alleged assault several days prior – and as a result we decided not to continue with the prosecution.
“We have written to Mr Collier’s loved ones to explain our decision making and have offered to meet with them.”
Detective Inspector Stewart Eastbrook also addressed the decision, saying, “We know a grieving family are still coming to terms with their loss and our thoughts remain with them at this time.”
Jimmy Collier had previously been in custody and was set to face an alternative charge of assault occasioning actual bodily harm.
The CPS made the decision to offer no evidence, and Mr Collier faces no further action.
The decision also considered evidence from two separate psychologists regarding Jimmy Collier’s mental state.
He remains in a secure psychiatric hospital.
