Inquest finds man died as a result of a collision and not the M1 smart motorway

An inquest has found how the death of an 83 year old man on the M1 in Derbyshire was the fault of a road traffic collision - and NOT the smart motorway.

In March 2019 - Derek Jacobs had to pull over on the first lane, after his tyre burst.

The inquest heard how a Ford KA collided with Derek's van - after making no attempt to break or move lane.

This crash then trapped the 83 year old between his vehicle and the safety barriers. He died at the scene.

The coroner told the court it wouldn't have happened if there was a hard shoulder - but that the fault lies with the KA driver not seeing the van.

National Highways admitted there was human error on their behalf - with a delay in road signs warning of an obstruction. They told the court they’ve now implemented new cameras to detect stranded vehicles quicker.
