Judicial review into plans for Wisbech incinerator won't be going ahead

Fenland District Council says it's "extremely disappointed"

A judicial review into the decision to build a huge £300 million waste incinerator on the Norfolk-Cambridgeshire border won't be going ahead.

Fenland District Council had appealed to the High Court, asking for a judge to review the governments' approval of the plans for Wisbech.

Now, a High Court judge has decided not to grant the council permission for a judicial review, meaning it won't progress to a hearing.

In May, the Environment Agency granted a permit to MVV Environment for the incinerator - which would be used to generate electricity and could burn 500,000 tonnes of waste a year.

It's long been a sense of contention, with campaigners arguing it will cause pollution in the built up area.

"Distress"

Ginny Bucknor, from the Wisbech Without Incineration group previously told us: "There appears to be a lack of understanding on the impact this has in Wisbech; surrounding this proposed mega incinerator are many factories, homes and schools...

"I cannot imagine the distress this is causing everybody, but particularly food factories in the area, major factories that supply Britain with their food."

Developers say they will be 'good neighbours'.

Fenland District Council says it will now look at all "available options" following the news, releasing this statement:

"Fenland District Council is extremely disappointed with the decision to refuse our application for judicial review on the Medworth Energy from Waste development.

"Given the judge's recognition that there were several deficiencies in the Secretary of State's decision to approve the incinerator, the Council was clearly justified in pursuing an application for judicial review.

"The Council is now giving careful thought to the judge's reasons for the refusal and is taking further expert legal advice as to potential next steps and looking at all available options."
