Rape accused tells court schoolgirl was 'enjoying herself'

A former police officer told a rape trial that he and his friend had sex with a schoolgirl - and that she was “enjoying" herself”.
Lee McMullan (33) said the then 17 year-old had gone with him and Darren Hunter (30) to his flat in Glasgow's Gallowgate days before Christmas 2017.
The pair had earlier met the girl in Prestwick, Ayrshire, where the men had been on a night-out.
McMullan told jurors he initially had sex with the teenager before Hunter asked could he “join in”.
McMullan believed the girl was 23 or 24 - before learning she was only 17.
The pair deny a rape charge at the High Court in Glasgow. They claim any sex was consensual.
McMullan was a serving officer at the time in the city's G division.
He was giving evidence at the trial.
McMullan told how he and Hunter decided to go to Prestwick for a night-out. He had booked a room for them at a hotel in nearby Ayr.
The court heard they had cocaine and vodka with them.
The duo eventually went to Elliot's nightclub in Prestwick.
McMullan's QC Shelagh McCall asked him: “Were you chatting people up?”
He replied: “I was single at the time. I was chatting to girls.”
After leaving the club, McMullan wanted to get food at a takeaway.
He said it was then they met the girl. McMullan claimed she seemed “fine” and he reckoned she was “23 or 24”.
Jurors have heard how the girl - now 19 - had earlier been out with a friend in Ayr. She had drank wine and cocktails that night.
McMullan initially believed the teenager was “attracted” towards Hunter.
He added: “She was being quite flirtatious.”
McMullan said the girl then joined the pair in a taxi back to the hotel.
He claimed it was there the teenager took cocaine.
McMullan said he later “wanted home to his own bed”.
Despite having been drinking and taken cocaine, McMullan decided to drive back to Glasgow. Hunter and the girl joined him in the car.
McMullan added: “She wanted to come with us. She was adamant she wanted to come back to Glasgow with us.”
He said the girl was then “flirtatious” with him in the motor by touching his hand as he changed gear.
They arrived back at McMullan's flat and he later went to the toilet.
Miss McCall asked: “At some stage, did you and her have sex?”
McMullan: “Yes, when I came out she was in the hall and took my hand into the bedroom.”
He said they were kissing and got undressed. McMullan claimed he carried out a sex act on the girl and also had intercourse.
Miss McCall: “Anything suggest that she did not know what was happening?”
McMullan: “No, she seemed to be enjoying it.”
He claimed Hunter eventually came into the bedroom.
McMullan: “He asked could he join in.”
The QC: “What do you think he meant by 'join in'?”
McMullan: “Have a threesome, as such.”
McMullan said he had done something similar before, but not with Hunter.
Jurors heard claims the girl performed a sex act on Hunter before he went on to have intercourse with her as well.
McMullan said the three of them ended up falling asleep in the bed.
McMullan and Hunter got up in the afternoon to watch a Barcelona and Real Madrid football match.
He said he found the girl lying on his couch. When she awoke, McMullan again claimed she appeared “fine”.
The teenager stated in her evidence she had no memory of having sex with anyone.
McMullan said he chatted with the girl in the flat and asked what age she was.
Asked what she stated, he recalled: “17 and was still at school. I remember me and Darren looking at each other and that it was not the best she was 17.
“I am not in the habit of sleeping with a 17 year-old.”
Jurors have previously heard how the girl's dad later picked her up before driving to a nearby police station.
