The girlfriend of a man accused of attempting to murder Steven 'Bonzo' Daniel told a jury he was with her on the day of the attack. Elaine McGhee, 32, gave Andrew Sinclair an alibi and claimed: “He was in my house with me and his kids”.
She told the court they sang happy birthday to his son around 12am then went to bed.
Miss McGhee was giving evidence at the High Court in Glasgow at a an alleged gangland murder bid plot trial.
Brian Ferguson (37), Andrew Gallacher (40), Robert Pickett (53), Andrew Sinclair (32), John Hardie (35) and Peter Bain (45) deny charges at the High Court in Glasgow.
The allegations include a string of attempted murders over a 15 month period.
It is alleged they targeted Mr Fitzsimmons, Thomas Bilsland, Gary Petty, Robert Daniel, and Steven Daniel.
The charge spans between June 2016 and September 2017 listing locations in Glasgow, North Lanarkshire, Renfrewshire and Manchester.
Miss McGhee told the court she had been in a relationship with Sinclair after they met in September 2016.
And, that he stayed with her at her flat in Cranhill in Glasgow's east end.
During cross-examination by defence QC Thomas Ross, representing Sinclair, Miss McGhee said Sinclair was with her.
Mr Ross put to her: “One of the matters the jury are interested in is an assault upon Steven Daniel or Bonzo, which happened on May 18.”
She said yes, and he continued: “It's of particular importance to know where Andrew Sinclair was round about 12.05 on May 18, 2017.”
Miss McGhee replied: “Yes. He was in my house with me and his kids.”
The court heard it was his son's birthday who turned 11 or 12 years old..
She said Sinclair arrived at her house in Cranhill around 11pm on May 17.
Mr Ross asked: “Did Andrew go back out again?” She replied: “No, we went to bed because he had to deal with the weans in the morning.”
She was asked if she knows the implications of giving a false alibi and if that's what she was doing.
The mum-of-his child replied: “No, definitely not.”
She said she could go to jail and that wasn't worth it for anybody.
The trial before judge Lord Mulholland continues.
