TERMS AND CONDITIONS FOR ABSOLUTE RADIO ON AIR COMPETITION: BAD BOYS RIDE OR DIE

(the “Competition”)

These terms and conditions (the “Specific Terms”) should be read alongside, and are in addition to, the Promoter’s (as defined below) general competition terms and conditions available online at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”). Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.

By entering the Competition, contestants agree to be bound by the Specific Terms, the General Terms and any other terms and conditions that are notified to the applicants subsequently (the “Rules”). Entries which are not in accordance with the Rules will not be valid. We reserve the right, in our sole discretion, to disqualify contestants from the Competition if we have any reason to suspect that there has been a breach of, or non-compliance with, the Rules.

This Competition is promoted by Bauer Radio Limited (“we”, “us”, the “Promoter”) whose registered office is at Media House Peterborough Business Park, Lynch Wood, Peterborough, United Kingdom, PE2 6EA and registered under company number 01394141.

1. ENTRY PERIOD

1.1. The Competition will run between the hours of 6am and 10am on 7 June 2024 during the Absolute Radio Dave Berry Breakfast Show (the “Competition Term”).

1.2. The Competition will officially open at 6am on 7 June 2024 (“Start Time”).

1.3. The Competition will officially close at the point at which the winner is announced by Absolute Radio staff (“End Time”).

1.4. Entries received before the Start Time or after the End Time will be invalid.

2. THE CHALLENGE AND HOW TO WIN

2.1. The challenge is to find presenters Dave Berry and Matt Dyson, or replacement presenter(s) if either Dave Berry or Matt Dyson is unavailable (the “Presenters”), who will be broadcasting live from a secret location on the United Kingdom mainland (the “Secret Location”).

2.2. Clues as to the Secret Location will be revealed on air on the Absolute Radio Dave Berry Breakfast Show and on Absolute Radio’s social media channels during the Competition Term.

2.3. The first contestant to physically arrive at the Secret Location and identify themselves to the Absolute Radio staff by saying the “key phrase”, will win the Competition.

2.4. If more than one contestant arrives at the Secret Location and says the “key phrase” simultaneously, there will be a tie break question to determine the Prize winner (see Tie Break Scenario 3.0).

2.5. The “key phrase” will be announced on air repeatedly throughout the duration of the Competition Term.

2.6. An entrant will not become the winner of the Competition until they have been informed by Absolute Radio staff that they are the winner.

2.7. The winner of the Competition will receive the Prize (defined at Prize 6.0) provided they meet the eligibility requirements and have complied with the Rules of the Competition.

2.8. The winner will be required to provide Absolute Radio staff with photo identification, such as a valid UK driving licence or passport, on arrival at the Secret Location. A photograph or scan of the identification document will not be permitted. Failure to provide valid photo identification could result in the winner having to forfeit the Prize.

2.9. The winner will be required to remain on site at the Secret Location for up to an hour after the End Time to participate in on air and social media content. Failure to fulfil this requirement could result in the winner having to forfeit the prize.

2.10. The name and hometown of the winner will be announced on-air on 7 June 2024 during the Absolute Radio Dave Berry Breakfast Show.

2.11. The Absolute Radio Production Team reserves the right to pre-record any part of the Competition with contestants before the broadcast with some elements of the show airing ‘as live’ where appropriate for the output of the show.

3. TIE BREAK SCENARIO

3.1. Only one contestant will win the Competition and receive the Prize.

3.2. In the event that two or more contestants arrive at the Secret Location and say the “key phrase” at the same time, there will be a tie break question to determine the Prize winner. The tie break will take place off air and will be run by the Absolute Radio production team.

3.3. The contestants will be asked a question with a definitive answer, and the contestant who provides the closest answer to the correct answer will win the Prize.

3.4. In the event that two or more contestants provide answers that are equally close to the correct answer, another tie break question will be asked. This process will be repeated until one Prize winner is determined.

4. ENTRY ROUTES AND COSTS

4.1. A contestant will be deemed to have officially entered the Competition and accepted these rules and agreed to be bound by them when they first act on a clue as to the whereabouts of the Presenters.

4.2. Contestants will not be reimbursed for any travel costs, loss of income or other costs incurred as a result of entering the Competition.

5. ENTRY RESTRICTIONS

5.1. The Competition is open to UK residents who are aged 18 years or older on the 7 June 2024.

5.2. The Promoter’s employees (and their family members), or employees of any company involved in the Competition, are not permitted to enter.

5.3. The Promoter reserves the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of the Rules.

5.4. The Promoter reserves the right to repeat the Competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with the Rules.

5.5. If you or any other person at your household has won a prize valued at £500 or more on any Bauer brand in the past 6 months, you nor they are not eligible to enter or win this competition. The full list of Bauer Media brands can be found here: https://www.bauermedia.co.uk/brands.

5.6. Use of a false name will result in disqualification from the Competition.

6. THE PRIZE

6.1. One winner will receive the following prize (the “Prize”): a cash prize of £3,000 payable by BACS into the winner’s bank account.

6.2. The Prize is provided by the Promoter.

6.3. The Prize is non-transferable, non-refundable.

6.4. The Promoter will endeavour to deliver the Prize to the winner within 28 working days of the winner being announced on air, that being the delivery period as stated in our General Terms.

  1. ALTERNATIVE COMPETITION MECHANIC IN EVENT OF CANCELLATION 7.1. If at any point during the Competition we believe that it is no longer safe or practical to run the Competition in accordance with the mechanic set out at 2.0, we reserve the right, in our sole discretion, to change the Competition mechanic such that it will become a “phone in” competition or cancel the Competiton.

7.2. It will be announced on the Absolute Radio Dave Berry Breakfast Show if the Competition becomes a “phone in” competition, and the new start time and end time of the competition will be made clear on-air.

7.3. The new competition mechanic will require you to call us on 0330 123 1215 if you believe you know the whereabouts of the Presenters.

7.4. The contestant must tell the Absolute Radio staff the precise location of the Presenters along with the “key phrase”.

7.5. In the event that multiple contestants call and provide the correct location and “key phrase”, a winner will be randomly generated once the lines have closed.

OTHER CONDITIONS

1. DATA PROTECTION.

Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2. INTELLECTUAL PROPERTY AND CONSENTS.

By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

3. MISCELLANEOUS.

• You are responsible for any and all costs you may incur in connection with the Competition, before, during or after the Competition, including entry and travel costs.

• We are not liable for any injuries or damages incurred during participation.

• We accept no responsibility for any loss of business or professional opportunity suffered by contestants as a result of entering the Competition.

• Contestants are responsible for their own safety and well-being.

• You shall take every care when travelling to the Secret Location (or any location you believe has been revealed in the clues) and abide by traffic regulations, highway codes, applicable laws and instructions of authorities. Please note that the Secret Location will be publicly accessible and poses no specific risk to the general public.

• When travelling and arriving at the Secret Location, or what you believe is the Secret Location, you shall not park your vehicle illegally or abandon it where it may pose a hazard to the individuals in your vicinity or the wider public.

• When travelling to the Secret Location, you shall take every care, during the portion of travel undertaken by foot, not to create hazards for yourself or people around you, which shall mean moving at a moderate and controlled speed at all times.

• You are aware of and accept responsibility for all inherent risks associated with the travel to the Location, which shall consist of ordinary risks assumed by one in the course of enjoying the public areas (indoor or outdoor) and using roads, highways and footpaths in everyday life.

• You shall not, under any circumstances, abandon minors, elderly people, animals or any living being in your care and requiring continuous supervision in order to participate in the Competition.

• Contestants who display any signs of anti-social or aggressive behaviour will be disqualified immediately from the Competition and escorted off the premises.

• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any Prize already won may be withdrawn and re-awarded to another entrant.

• You agree and give your full consent to being on camera and video recorded by us in connection with the Competition.

• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given, including whether they are correct, we may amend, at our sole discretion, what we deem a correct answer, however, we reserve our right not to, and our decision in either case shall be final and not subject to any further discussion or complaint.

• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

• Insofar as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

• We reserve the right to cancel, amend, terminate or temporarily suspend the Competition at any point during the Competition at our sole discretion, with no liability to any entrants for any costs you may have incurred in connection with the Competition. We reserve the right to amend the Rules at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
